How to Find Your Trademark Class in India
India follows the Nice Classification, which puts every product and service into one of 45 classes. Classes 1 to 34 cover products and classes 35 to 45 cover services. You file a trademark application for the classes your brand will be used in, so the class decides both where your name is protected and how much government fee you pay.
Type what you sell, in English or in common Hinglish words such as chudiyan, chadar or masala. The closest class comes first, along with the word it matched. Some products can fit more than one class, so read what each class covers before you choose.
Common Trademark Classes for Online Sellers
Clothing and footwear are in class 25, jewellery and watches in class 14, bedsheets and towels in class 24, and bags and wallets in class 18. Cosmetics and soaps are in class 3, phones and phone covers in class 9, kitchenware in class 21, and packaging such as cardboard boxes and courier bags in class 16.
Class 35 covers advertising and retail services, including running an online store. Many marketplace sellers start with the class of their product. If you are unsure, confirm with the official list or a trademark agent.
Class First, Then Check Your Brand Name
Finding the class does not tell you whether a brand name is free. After you know the class, search your name on the official IP India public search, using both the wordmark and phonetic options, because a similar sounding name can also be a problem. This tool does not check the register.
